4. The Supreme Court
Appointing Supreme Court justices is a huge issue to many voters, but the men and women in black are surprisingly independent once they’re on the bench. Richard Nixon appointed Harry Blackmun, the author of the Roe v. Wade decision. George H.W. Bush appointed David Souter, who went on to become part of the liberal wing of the Court. Chief Justice John Roberts cleared the way for the Affordable Care Act although he was appointed by neo-conservative George W. Bush. Historically, many presidents have ended up thoroughly regretting their SCOTUS appointments.
So why should anyone think that either Donald Trump or Hillary Clinton will be better at this than their presidential predecessors? Yes, whoever is elected president will likely have several Court appointments to make, but no one knows how they will ultimately act once they are on the bench and free from political pressure.
Case in point, Barack Obama has lost more cases in front of the Supreme Court than any other president—and that includes 44 unanimous losses while he has two justices on the Court that he himself appointed.
