ZEPHYRHILLS, FL – Meagan Simmons, a mother of four is suing a website that posted her mugshot after she realized that the photo became a meme and was being widely circulated around the Internet.
Simmons became the subject of millions of memes when a photo of her arrest began being circulated with captions such as “Arrested for breaking and entering – your heart” and “Looks do kill.”
The woman is suing the background check website instantcheckmate.com for using her image for their own “financial reasons.” Apparently the site used her photo for their advertising without compensating her.
Simmons’ lawyer said “One of the services the Web site offers is finding and locating criminal records. And it’s associating her with criminal activity. If Tom Cruise is promoting Axe Body Spray, the guys at Old Spice can’t use his picture, it’s the same issue.”
What was Simmons arrested for? “I was out drinking in Tampa with a girlfriend at the time,” she said. “We were riding together and I wasn’t planning to drive at all that night.”
“It was a really fun night but she saw her boyfriend and said she wanted to go with him. So I decided to drive home which was a terrible idea.”
“I had just been crying when the photo was taken and I was drunk. I knew I’d caused a lot of trouble and my parents were really upset and I was really upset. I wasn’t thinking about how I looked at all.”
