Woman Says Cops Enter Her Home Without Warrant, Stomp Her Parakeet To Death

STATEN ISLAND, NY – A woman is suing the city of St. George after she claims police entered her home without a warrant, beat her family, pulled her parakeet out of the cage and stomped on it.

Evelyn Lugo claims that officers entered her home on September 2nd, 2012 as her family was celebrating Labor Day. The officers were questioning Lugo’s son, Edwin Avellanet, when he was outside throwing away some garbage. Officers reportedly asked him for identification and when he refused, police allegedly grabbed at his right arm, causing him to flee back inside his home.

Lugo claims she opened the door to let her son inside and was thrown outside by police. The officers then pepper sprayed Lugo’s daughter and son, according to the report she filed. Then the police knocked the cage of Tito the family parakeet onto the ground, ejecting the bird onto the ground. Officers then stomped on Tito, crushing the bird to death.

Victims of the attack  were treated for multiple facial lacerations to the head as well as an asthma attack brought on by the violence. The city’s law department did not comment on why police entered the home but issued a statement that said, “We will review the allegations in the complaint, which at this point are merely allegations.”
