She Sexually Assaulted Him While He Was Drunk… But Now She’s The Victim?

A student at Amherst University in Massachusetts is suing the university after he was expelled for sexual assault charges.

Two years ago a male student, who is using the pseudonym John Doe, had a female classmate perform a sexual act on him while he was blacked out drunk, and now, two years and couple social justice classes later, the girl filed a sexual assault charge against him. And he was expelled by the university as a result.

Even after John Doe’s lawyer had discovered text messages that prove the accused student did not initiate the encounter and in no way sexually assaulted the accuser, Amherst refuses to reopen the case.

It should be noted that the school has adopted the “yes means yes” policy, in regards to sexual consent; meaning a person has to ask permission before performing any sexual act on another person and receive an affirmative response.

This is where things get weird.

There are two claims to refute:

1. By Amherst’s “yes means yes” policy, Doe would have had to give affirmative permission to his classmate to perform the sexual act on him for the incident to be consensual. Which he was incapable of doing. Which would make his classmate the assailant. Which would then mean she should be the one expelled.

2. The accuser is citing the “yes means yes” policy in order to expel Doe, but she and the university are forgetting the most critical part of the accusation; that the victim was the recipient of a sexual act. Doe was blacked out. He was incapable of performing any sexual act. So how could she accuse him of being the assailant? Especially since there is text message evidence that Doe did not instigate any sexual activity.

Common sense is not so common, you know.

The accuser said during her hearing that she only texted one friend on the night of the assault as she felt “very alone and confused.”

But the texts give no indication of an assault against the accuser. Rather, she texted her friend “Ohmygod I jus did something so fuckig stupid”and “it’s pretty obvi I wasn’t an innocent bystander.”

She also complained that another man, who had come over after the alleged assault, had taken until 5 in the morning to finally have sex with her.

Did I miss something? Or are college administrations now so intimidated by fear-mongering campus justice warriors that they’re willing to falsely accuse and expel innocent students in order to save some face?
