Revenge Porn Could be on the Ropes in Golden State

Kamala Harris, of whom Barack Obama once said “happens to be, by far, the best looking attorney general in the country,” is looking to crack down on revenge porn in her state of California.

The Daily Caller reports:

California Attorney General Kamala Harris, announced in a statement Oct. 14, the creation of a new, online resource to help combat the threat of revenge porn.

“Posting intimate images online without consent is a cowardly crime that humiliates and belittles victims,” Harris said at a press conference. “These new tools will assist law enforcement in combating cyber exploitation and support victims in seeking justice. I would like to thank our partners from our task force, whose work will have a global impact in combating this heinous crime.”

The resource hub is a one-stop-shop for stopping or dealing with instances of cyber exploitation.

The site gives victims instructions on removing images from various online outlets. They also provide direct links to remove nude photos from popular sites like Snapchat, Flickr, and 4chan. Guidelines for law enforcement are also noted, including a listing of all the state’s computer crimes.

To assist technology companies, the site consolidates some of the common, industry-adopted best practices. Guidelines for terms and conditions, community outreach, and a verification process are all mentioned.

According to Ars Technica, the online hub is only one phase of Harris’ plan. “She’s asking for the California legislature to pass additional laws as well. AB 1310 would allow state lawyers to prosecute exploitation suspects in the victims’ jurisdiction, while SB 676 gives law enforcement ‘a process for seizing and destroying cyber exploitation images,’” the site says.

Twenty-three states currently have laws on the books meant to crack down on revenge porn, and there is currently an effort to make revenge porn a federal crime. Congresswoman Jackie Speier recently introduced a bill in Congress:

“The bill, set to be introduced this spring, would make revenge porn a federal crime. It’s designed to create new criminal statutes that not only apply to the people who run revenge porn sites but also criminal liability to the individuals who upload and share the content, which is where things get controversial: Even sites that host links to the content, like Facebook and Google, could face criminal penalties for enabling distribution if they’ve been notified of the links and don’t take down the links in a timely manner. Those penalties will be determined on a sliding scale of sleaziness. While there will be no minimum penalty, for revenge porn bill will set a maximum penalty for revenge porn offenses that will include jail time.”

Some free speech advocates say such laws go too far. As libertarian par excellence and legal expert Judge Andrew Napolitano has said of revenge porn, despite its obvious unsavory quality, “Criminalizing the distribution of that which was freely given and freely received would be invalidated under the First Amendment. The First Amendment is not the guardian of taste.”
