Marissa Alexander of Florida was being abused horribly by her husband, sometimes in front of her three children. But one day, she decided she wasn’t going to take it anymore. Alexander fired a warning shot into the ceiling of her home to scare her abusive husband away. For this, she was arrested and sentenced to 20 years in prison.

But now comes the news that she will get a new trial. She had never been arrested before but because of mandatory minimum laws, the Judge felt compelled to force her to serve the full 20 year. Florida has a ‘stand your ground’ law that became an issue during the Zimmerman trial.

UPDATE: The Zimmerman trial did not use the stand your ground law. Noted. 

Marissa’s retrial comes about from the issue of her having been forced to prove her innocence in the case. The government flipped the burden of proof and forced her to prove that she was assaulted, rather than them being forced to prove their case that she was guilty. Now it looks like she’s got a second chance at freedom and there is talk that the prosecutors may choose to drop the case before a retrial.

How many more innocent citizens will we allow to be caught up in our criminal justice system because of mandatory minimums? Marissa Alexander wasn’t the first, and she certainly won’t be the last.
