Although the officer claims the weapon was concealed, camera footage from the officer’s vehicle revealed that the firearm was in plain view.
The arresting officer claims that as he passed McMorris from the other direction fifteen minutes before the arrest on his way to another call, he was unable to see the openly carried firearm, meaning that McMorris was in the wrong for carrying an unlicensed concealed firearm.
Police have thus far not released any evidence supporting the officer’s accusations.
McMorris filed a civil rights lawsuit against the police department in federal court.
It is utterly absurd that, in a country with a constitution protecting the right to bear arms, the difference between felony charges resulting in imprisonment through the Christmas holiday and perfectly legal behavior depends on whether an officer can see around the creases of a jacket while flying down the highway on his way to an emergency call.
