Get A Warrant, Flatfoot!
Authorities in the great state of Iowa will now need a full blown search warrant if they intend on searching your vehicle. The case arises out of a stop three years ago, where a man was pulled over for driving with expired plates. Jesse Gaskins admitted to officers that he had been smoking pot, whereupon officers promptly placed him under arrest, and performed a search of his vehicle.
Inside the car, officers found a locked safe, and used a key they found to open it. Inside was marijuana, a loaded gun, and pipes. A court ruled this week that the search was illegal, and that officers will be required to obtain a warrant.
Scott County Attorney Michael Walton explained that, “Now it will be required to prepare a warrant. It has to be on paper, it has to be presented to a judge, and a judge has to review it and sign it. And then the search can be conducted.”
“Finding a judge early morning, 3:00 in the morning, on holidays…although there are judges on call, it can be difficult,” said Walton.
Other options do exist if they can’t get ahold of a judge.
“If the officer has probable cause for a search, they may wish to impound the vehicle for that search,” he said.
