They took his gun, his child and his freedom. Now he’s taking them back! (VIDEO)

“God forbid anyone move state to state, because they’re going to end up behind bars.”

In 2009 Brian Aitken’s parents had dialed 911, worried that he was a potential danger to himself due to marital problems and stress. He had said earlier that “he didn’t see the point in being here if he couldn’t see [his] son”. Aitken’s mother hung up the phone before the call was completed…

But then 911 called her back.

She told them that she was just worried about her son, she didn’t mean to call them. But the authorities wanted his contact information. They called Aitken to check on him and after speaking with them, he affirmed that he was not suicidal.

Then they asked a strange question. They wanted him to come to the department to check for bruises, as they believed he may have been assaulted. Brian explained to them that he wasn’t and asked to clarify if he was legally required to go to the police. They said no and Aitken hung up the phone. Minutes later he received another phone call.

It was the police again.

15212-police-wallpaperA “General Alert” had been issued in New Jersey and he was ordered to return to Mount Laurel or the police would “pick him up” and “bring him back”. The authorities had spoken with his mother again and asked her if Brian was a gun owner. She confirmed that he was. That was all they needed. Brian turned himself in and a search of his vehicle revealed that he had three unlocked and unloaded handguns in his trunk. Brian had moved to New Jersey from Colorado and hadn’t registered his guns in his new state, even though there is no requirement to do so. Still, the government would demand a pound of flesh.

Aitken was sentenced to seven years in prison with a three-year mandatory minimum by a Judge who refused to allow the jury to hear about exemptions to New Jersey’s gun laws, even though they specifically asked about them three times. There was no need to sentence Brian on a gun charge when he had acquired his guns legally in Colorado. This was nothing more than a case of government vindictiveness.

New Jersey Governor Chris Christie released Brian Aitken from prison, where he had been for four months.

From Jail to the Supreme Court

Brian AitkenNow Brian Aitken is free. But he’s still a felon. The clemency that granted did not restore his voting rights, nor did it give him the ability to be whole again with his family. Brian’s case demonstrates that gun laws can destroy families, and put ordinary, law-abiding citizens in prison for years over technicalities. Brian harmed no one, and now he’s struggling to put his life back on track. But he’s not taking it sitting down… he’s taking it to the Supreme Court.

In March of 2012, the New Jersey Superior Court, Appellate Division overturned Aitken’s conviction of ‘Illegal Possession of Firearms”. He was also acquitted of the “Illegal Possession of High Capacity Magazines’ charge. However, his Illegal Possession of Hollow-point Ammunition was upheld due to the fact that the exemptions to charges do not specifically allow for an individual to transport ammunition from one house to another while moving. In other words, he’s still on the hook.

Bad laws ensnare good people and Aitken’s case proves that. Brian’s “crime” could happen to any American moving around the country. Now that he’s free he’s writing a book, to help fund his court case against the government’s gun laws. If Brian’s case were to be heard, it could mean a whole new level of freedom for all gun owners. But more importantly for Brian, it could mean he would see his son again. So he’s taken it upon himself to write a book telling his story and he’s getting it out there to help raise money to take on the government’s arbitrarily punitive gun laws.

He’s writing it because wants his son one day to know that even though he wasn’t with him for the first few years of his life, he can read the story and know that his father loved him.
